The Multistate Bar Examination is a 200-question multiple-choice exam administered over six hours (two three-hour sessions of 100 questions each). The MBE counts for 50% of the total UBE score. The other 50% comes from the MEE (6 essays, 30%) and MPT (2 performance tasks, 20%).
Apply federal law and majority rule unless the question specifies a particular state. For Evidence, always apply the Federal Rules of Evidence exclusively. For Contracts, assume UCC Articles 1 and 2 apply to any transaction involving the sale of goods. For Torts, assume pure comparative fault and joint and several liability apply unless otherwise stated.
Each of the seven subjects (Civil Procedure, Constitutional Law, Contracts, Criminal Law and Procedure, Evidence, Real Property, Torts) has 25 scored questions. An additional 25 unscored pretest questions are distributed throughout both sessions. You will not know which questions are unscored.
MBE scores are scaled and vary by jurisdiction. Most UBE jurisdictions require an overall UBE score of 260-270. Since the MBE is 50% of your UBE score, a strong MBE performance is critical. A scaled MBE score of 140+ is generally considered competitive.
